Tier 1 General - Re-entry to UK - Very Urgent

Post by sivaram_ng » Tue Dec 14, 2010 8:10 pm

Hi Guys

I hold a tier 1 which is valid till June 2011. I was in UK from Oct 2008 till June 2010 (18 months). I have been in India since June 2010 till date. Now I plan to travel to UK (with a job) in Jan 2011. Pls help me with the following questions

- Can I re-enter UK in Jan w/o issues - given that I have only 6 months for my visa to expire and have spent nearly 180 days outside UK ?

- My wife has a tier 1 dependant visa. I am planning to apply for my son as well. My UK bank account is still active and has close to 10000 GBP for last 6 months. Can I use those statements from UK bank for my son's application, though I have not done any transactions for the last 6 months - bcoz I have been in India during this period

- How does my staying out of UK for more than 180 days affect my extension ?. Also I only hold a bachelors degree. Will this impact ext under the new rules effective April 2011 ?

Many Thanks,
Sivaram

Yes, you can reenter without any trouble.
Yes, you can use your UK bank account in current condition for mainteance funds.
Stay outside UK does not affect extension application, extension application is solely points based assessment.
Bachelor degree is not an issue here.

Hi

Thanks much !!

Couple more:

- As you say if extension is based on PBS, then how many points will it get for a bachelor's degree ?

- Can I switch to Tier 2 now from India ? If I do that, then I believe my Tier 1 will be cancelled ?. My company is willing to process tier 2
(I may need to do it, assuming worst case, I will not be able to extend my Tier 1 in UK)

Many Thanks

Please read http://www.bia.homeoffice.gov.uk/workin ... gyourstay/ regarding extension points. Everything is well explained there if you look around.

Yes, you can switch to T2 from India.

Yes, you can switch to T2 from India.
Also, if you are talking about extension after April 2011, no one has a clue about that. Keep watching BIA website.
