Tier 1 general recent changes October 2009

Hello There, I am mba graduate and holding psw visa, but i am also studying on a full time course doing second masters (MSC) i also have plans to do PHD in future coz i have only one semester left to complete my second masters. i am currently self-employed and my next step would be tier1 general,. i have read the new rules and it concerned me because according to new rules students can not apply for the tier1 general,. correct me if i am wrong,. moreover swinging moods of HO and changes in highly skilled visa rules sickens me and it seems that the changes are never ending, End of the day people like me will fed up and move to another country,. i am just confused and want to decide in time, instead of delaying. your comments and suggestions are required and will highly appreciate, Thanks in advance.

Students still can apply for Tier 1. For Tier 1, in "previous earnings section" one can claim points for any consecutive 12 months out of last 15 months, before the date of application.

Before October 01, 2009, students were exempted from this condition (claiming points for any consecutive 12 months out of last 15 months), if they show that during this time they were enrolled as a student. So they could show the earnings before they became student.

From October 01, 2009, students have no longer this exemption. The must show proof of salary for any consecutive 12 months out of last 15 months, before the date of application, to claim points.

This means that most of the students, who just study and do not do work, cannot claim points, or may be will earn less points. You said that you are self-employed, so please check points based calculator to see if you can qualify for Tier 1 or not?

Conditions always change, not only in UK, but also elsewhere. This is life and show must go on!!!

you are holding PSW so how come you are student?

thanx for the reply mv it was detailed reply and i assume that i still will be able to apply for tier 1 general if i fulfill the earning requirements,.

@nabeel i am studying on psw besides working, coz psw does not stop u from studying,.. i think u can even study on tier 1 general if u really want to,.. correct me if im wrong..
