Yeah. They should have reported the transfer of sponsored employees. I guess the caseworker is looking for that report. Check page 43 of the guidance for employers:shalgo23 wrote:Hi Many Thanks for the reply. Very much appreciated.
Actually, both companies have followed the TUPE transfer procedure for all employees but I am wondering do they specifically have to report for Teir 2 employee transfers or would it be ok if home office is been informed as part of all employees?
I have submitted below two letters along with employment contract from Company B
1) one from my old company saying that I will be TUPE'd to Company B from JAN 1 2016
2) second from my new company stating my employment will be transferred under TUPE from Jan 1, 2016.
But, the case worker said he cannot see any email correspondance or any evidence regarding my TUPE transfer. I quiet dont understand what home office is expecting. Do I have to have any proof or evidence apart from those 2 letters & my contract?
I think a senior member would be able to advise you better though13.9If you are completely taken over or merged into another organisation and your
sponsored migrants are moving to a new organisation you must:
a) Report the change via SMS, including details of all of your sponsored migrants who will
be moving to a new organisation. You must make the report within 20 working days of
the change.
b) Use the migrant reporting facility on the SMS to report if any of your sponsored
migrants are not moving to the new sponsor - these migrants’ leave, or worker
authorisation will be reduced to 60 calendar days.
