TIER 2 GENERAL VISA Generic questions

HI All,

I am an indian IT Consultant and i have been working in UK for last 18 Months and my work is getting over from current sponsor and looking for fresh sponsor and i have series of questions in my mind and I am looking for some answers to my queries on the same.

Q1- My Current job is coming to an end and looking for Fresh sponsor and i have visa till 2015. Do i have any specific time line to find a new sponserer ?

Q2- If i get job offer from some other company in between can i start working before Tier 2 Transition takes place ??

Q-3- is that Labour market Testing is required for Tier 2 General visa Switching between the companies ??

Q-4- Any Registered Tier 2 General Sponsor Company have permanent opportunity if i apply and get offer can i take the responsibility of Visa swithiching to another company ??

What visa are you currently on? These answers assume you are already on a Tier 2 General visa...

Q1 - This is somewhat of a grey area. Your visa may be curtailed by the Home Office. They can do this 28 days after your sponsor notifies them of your departure (which is max 10 days after your end of employment). They can curtail your visa to 60 days after the decision to curtail has been made. This means you have a MINIMUM of 28 + 60 days to find a new sponsor.

Q2 - You cannot begin work for a new sponsor. You must have your new BRP and visa decision before you should begin work. This is a recommendation, as if you are found working for your sponsor before you have these documents, your sponsor can be fined up to £10,000 and you would have been working illegally. I wouldn't recommend that.

Q3 - Unless your job is on the Shortage Occupations list, an RLMT must be conducted.

Q4 - Not sure what you mean by this question. There are steps the company would have to take in order for you to make the application, like issuing a CoS and conducting the RLMT (see Q3). However, actually submitting the application is generally left to the job applicant, i.e. you.

Again, all of this assumes you are ALREADY ON A TIER 2 GENERAL. If you are not, some answers may be different...
