WP to Tier-2 ICT and Absence

Hello Board members / CR001,

Appreciate if anyone can provide your inputs on my case as given below

1) I first arrived in UK in September 2008 on Work Permit and stayed till April 2009.
2) Applied Tier 2 ICT from India in August 2010 (within 28 days of expiry of WP Visa which was valid at the time of applying new Visa from India)
3) Came in September 2010 and stayed till December 2010
4) Came back in December 2011 (on same Visa as mentioned in point 2) ) and have been staying in UK since then ,without more than 35 days break in any one year period.
Have been extending same Visa as mentioned in point 2)

My questions are
1) Since I applied for Tier 2 ICT within 28 days of expiry of Work Permit Visa , would that be considered continuation of original Work Permit Visa.
2) Would I be eligible for ILR once I complete 5 years in December 2016.

this may not be of much relevance now given that there perhaps will be only handful of Work Permit -> Tier 2 Established staff left in UK.The case was uncertain because of the gaps.

My ILR application with the above case was approved at Croydon this week.

Required documents were submitted , only question asked was why my dependents are not applying with me.(they are not eligible yet).
