WP & Tier 2 ( ICT - established)

Post by hellohappy » Tue May 24, 2011 12:27 pm

Hi,
I need help and advice in my case.
1. Came to UK in May 21st 2006 – 2 yearsWP
2. May 2008 – 2 years WP extension
3. 19 April 2010 – Tier 2 ( ICT – established) for 2 years

With new rules in place, am I eligible for ILR? If I see rules in 245GD, it says I am eligible. But 245GF is confusing. As per 245GF (C) I am eligible, but 245GF (D) is confusing.
When I call home office I get miss response. As my ICT is after April 6 2010, they say I am not eligible. But some say, Tier2 ICT is not first permit so I am eligible.

Request expert help on my eligibility.

Did you entere UK in 2006 with a WP authorisation as an intra-company transferee? If you don't know, check with your employer.

In such case, you will be eligible for settlement (245GF(d)(ii)).

Hi, I will check. many thanks for the clarification.

What about 245GF(c)? also 245GD? Are these are different from 245GF(d). Sorry to ask again, but it is bit confusing.

You already meet 245GF(c). The question is whether you meet 245GF(d).
245GD is not relevant for settlement.
