Tier 2 ICT extension

Hi,

I had initially come to the UK on a Tier 2 ICT visa in May 2011. The application for this visa was made on 5th April 2011 in India. The vignette in my passport shows the visa as Established Staff valid till 25th April 2012. I then made an extension application in April 2012 for two years which was successful and now this visa term is going to expire end of next month.

As mentioned above my initial visa application on 5th April 2011, the visa got approved and stamped in my passport on 22nd May 2011. Because the initial visa got approved on 22nd May 2011, does this mean that I have to meet the latest salary requirement for Long Term visa category if I need to extend my visa again? Shouldn't they (UK visas & immigration office) look at my initial application date and apply rules in place before 6 April 2011?

I ask this because a colleague of mine who had a similar visa history made an extension application and got rejected due to not meeting salary requirements.

So did you mean the min. salary threshold requirement of £40600 pa for the T2 ICT long-term extension ? I suppose the above salary figure is required only for new entry clearances/visas granted after 6 april 2011

the £40,600 salary threshold does not apply to you but you must be paid the minimum appropriate rate for the job as set out in the codes of practice.

See para 75A in Appendix A to the Immigration Rules:

75A. No points will be awarded if the salary referred to in paragraph 75 above is less than £40,600 per year where the applicant is applying in the Long Term Staff sub-category, unless the applicant is applying for leave to remain and previously had leave as:
(i) a Qualifying Work Permit Holder, or
(ii) a Tier 2 (Intra-Company Transfer) Migrant under the rules in place before 6 April 2011,
and has not been granted entry clearance in this or any other route since that grant of leave.


Also, the skill level for the job need only be NQF level 3

I have done my Tier 2 ICT extension (Priority Postal route) last year and I was also in similar situation as that of you.
Answer is NO, it wont affect you , as you are extending your current Tier 2 visa, you will not be affected by new min salary restrictions.
You should be fine and your extension will be approved (Mine got extended for 2 years)
