Tier 2 ICT, looking for options of extending beyond 5 years

Post by Samarth1981 » Fri Sep 04, 2015 5:43 pm

Hi,

I came to UK in September 2011 on a Tier 2 ICT visa. I have been with the same company since then. Following are my details

First visa -
Valid from 05/09/2011 to 05/10/2013
Type (as mentioned on visa) - VISA TIER 2 ICT LONG TERM STAFF MIGRANT

Extended visa in 2013 -
Valid till 19/09/2016
Type - T2 ICT LONG TERM LEAVE TO REMAIN

I have a sponsor now who is willing to sponsor me for tier 2 General visa. My queries are -
1. Am I eligible to move to Tier 2 General?
2. Is my visa type - Tier 2 (Intra company Transfer: established staff)?
3. If I cannot switch to Tier 2 General visa, is there any other way to extend my stay here once I complete 5 years next year?

I would really appreciate your response to my queries.

Thanks

1. You can move to T2 General if you are able to find a sponsor. However, you will be subject to a cool-off of 12 months from the day you leave UK before you can apply for T2 General.

2. You yourself mentioned the visa type. How can it be a different category then. Established staff category has been stopped and has been replaced with Long term staff migrant.

3. If your salary is more than 155,300, then you can continue your stay for 9 years on T2 ICT, else 5 years is the limit.

To add to the above,
if you can find a job that pays £155,300 or above, then cooling-off period doesn't apply.
Life isn't fair, but you can be!
