Tier 2 ICT visa - Am I eligible for ILR after 5 years

Post by kkumar75 » Sun Mar 10, 2013 8:33 pm

Hi,

I needed some advice on my present immigration condition. I am giving below the details of my current status and my queries.

I came to UK on 13th Jan 2011 on Tier 2 ICT visa and since then I am working here in UK as a contractor. My wife is on Tier 2 dependent visa (issued at the same time).

Now, I want to work as an independent contractor and get rid of my visa dependency. Is there any way for this?

My queries are:
1) Can I switch to Tier 2 General visa by staying in UK (if I get a UKBA registered sponsor)?
2) What is the fastest way to do this switch (in terms of days)?
3) What will be the total application cost to do the same?
4) Can my wife work here in UK in a permanent job (she is on Tier 2 dependent visa)?

5) Under the present circumstances/rules, am I eligible to get an ILR after I complete 5 years of stay in UK?

Could you please let me know, if you can help me on this?

Thanks,

Kaushal Kumar

1) Can I switch to Tier 2 General visa by staying in UK (if I get a UKBA registered sponsor)? yes, if your current leave is T2 ICT Established Staff

2) What is the fastest way to do this switch (in terms of days)? find a sponsor who has an available T2G allocation and is prepared to do a RLMT (takes 28 days) and then assign a CoS

3) What will be the total application cost to do the same? check the application form

4) Can my wife work here in UK in a permanent job (she is on Tier 2 dependent visa)? yes, she is allowed to work but will have to get a new visa when you get yours

5) Under the present circumstances/rules, am I eligible to get an ILR after I complete 5 years of stay in UK? no, your ILR clock will only start ticking from the time you get your T2G visa

Could you please let me know, if you can help me on this?

Thanks,

Thanks for the answer, Manci.
But could you also tell me after switiching to T2G, how long I will have to wait for the ILR. I mean will the time spent under the T2 (ICT} category of 2 years will also be counted for my ILR eligibility?

Thanks,
Kumar
