Tier 2 - ICT | What options next?

Post by indian_curry » Sat Apr 16, 2011 12:13 am

Hi All,

I am currently in UK with a CoS issued in December 2010 and arrived in UK by January 2011 on Tier 2 (ICT).

I understand that I can't convert my Tier 2 - ICT to Tier 2 - General or Tier - 1 General. (correct me, if I am wrong)

If I wish to stay in UK beyond my assignment with my current employer; what options do I have? And for how long can I stay in UK? Can I get a Permanent Residence permit after spending XX years in UK? If yes, what would be XX?

Tried searching UKBA and forum; but couldn't find anything concise at one place. Apologies for my ignorance.

Thanks in advance,

Regards,

Tier 2 (ICT) migrants is no longer a qualifying category for settlement.

Possible option: Partner of a settled person / British citizen

I am already married. :)

No other way to qualify for settlement?

Can I change job on ICT here?

Can my partner work as dependent? If yes, then will she have to get her visa changed?

No, you cannot change your employer.

Yes, but not as a doctor / dentist in training post. No.

Thanks Sushdmehta for your responses.

I have just one follow up question: If my spouse is working as Tier 2 Partner; so I assume her validity of work will expire alongside expiry of my Tier-2 ICT visa. If the company she's working with, want her to extend her stay, then what could be the options?

Without understanding the spouse issue; in a nutshell following could be course of action: Please correct me if I am wrong.

1. Continue with the current employer for as long as possible.
2. Hope for change in visa rules and a new set of HSMP type policy after London Olympics.
3. Let spouse work on dependent visa
4. Just before going back; find an employer, who can sponsor Tier 2 general visa; get back to India and apply for another stamping of Tier 2 general. (Risk involved)
5. Come back again as Tier-2 General candidate and stay for further longer duration.
6. Apply for ILR after completion of 5 years.

Thanks again for your responses. They are much appreciated.

Eligibility to work and to remain in UK expires on the date that the person's leave expires.

The employer will need to assign a "restricted" CoS to the applicant, and then an entry clearance application will have to made from outside the UK.
