Tier-1 ILR or Leave To Remain Which to Apply

Post by ashehzi » Sun Jan 26, 2014 6:50 pm

Good Evening All,

First time, I applied for Tier-1 General visa from abroad before 06-Apr 2010. My first "Leave to Enter" was valid from 01-Jun-2010 to 01-Jun-2012. I didn't enter to UK first time within 90 days of 01-Jun-2010, rather I first came to UK on Tier-1 visa on 10-Oct-2010. This meant I was like 40 days late of the first 90 days period. I got my extension on 29-May-2012 valid from 01-Jun-2012 to 01-Jun-2015.

Now you might be wondering if I applied first time before 06-Apr-2010, why I didn't get first time three years visa; well that was visa officer mistake, so when I applied for extension they gave me 03 years extension in order to make five years from 01-Jun-2010 to 01-Jun-2015, so ignore this for the moment.

Also, I have only been out of UK for just 10 days and don't have plans to go outside UK till I get ILR, meaning I left UK for very less 10 number of days in total.

Now, I understand I didn't come to UK within first 90 days of 01-Jun-2010, rather I came here on 10-Oct-2010. Now, does this mean 100% that I must apply for extension before 01-Jun-2015 and I cannot apply for ILR next year in May. I must have in total 02 extensions (1 already done, 1 due next year) before I am eligible to apply for ILR. If 2nd extension is must, what do you say if it is a good idea to apply for extension now instead of waiting for 1st extension to expire on 01-Jun-2015. By doing so, I won't have to spend money twice next year and can spread the cost to this and next year.

What are your thoughts on above please.

Kind regards.
