WP+Tier 1 = ILR?

Post by sherkhan297 » Sat Nov 13, 2010 10:10 pm

Hi,
I had a query on the WP+Tier 1 route described below..

I entered the UK in Sep 2006 on a WorkPermit.
This was renewed in the UK in June 2008 and the WP was valid until June 2010.

After June 2010, had I renewed with the company, I would have got a tier
2 (ICT) as the workpermit was replaced with Tier 2 categories at the end of 2008.
It would have been ICT as the company was relocating employees via the intra company transfer route
(however there was no such distinction of routes in the previous format namely Workpermits)

I changed to Tier 1 (General) in Jan 2010 and this is now valid till Jan 2013.

I would complete 4 years 11 months in Aug 2011 with the following status
Sep 2006 - Jan 2010 (Workpermit)
Jan 2010 - Aug 2011 (Tier 1 General)

Would this be a valid route to ILR and could I apply next year, provided the current rules remain?

Thanks for all the help.
Regards

Thanks..

Another query on the same situation...

I was away in between the 5 year period mentioned below for a little over 3 months - 105 days on work, however there was no break in visa status at any point and this trip was work related.

I understand that the rules state that you should not have 3 months away, as this was work related would I be eligible for discretion?
(was paid abroad during this short period)

What sort of letters would I need to provide to prove the absence?

was three months at a stretch? u can get away with it but is at caseworker's discretion (thought i havent heard of many people having problem with absences when company can certify absences)

u will need a letter from employer confirming dates out of UK and also confirming that it was mandatory for your work. it would also help if they can put (or you can show through payslips and bank statements) that during thsi time u were paid in UK.
