Applying under Tier -2 Intra company Transferee - Established Staff
Need clarification on the tier 2 guide lines item 46 Maternity PAternity or Adoption Leave
I am working with my current company for the last 2.5 years
and i have been Absent form work (under loss of pay) from January 2010 to March 2010 (visited US to accompany my wife)
My question is do i still qualify for Tier 2 - Established category considering items 44 to 47 of the tier 2 guidance
Find below the sections I am referring to in the tier 2 guidance
Maternity, paternity or adoption leave
44. If you are applying in the Established Staff sub-category and you have been absent from work on maternity, paternity or adoption leave during the last 12 months, we will accept evidence that you have been working for any 12 months within the last 24 month period.
45. For example, if you worked for nine months, took 12 months leave and then returned to work for three months before applying, you can provide evidence of working for the two periods, making 12 months in total.
46. This exception applies for a maximum of 12 months maternity, paternity or adoption leave It does not apply to other breaks in your working, for example a period of study or a career break. "
