Hi Guys

Hope you are doing fine.

My husband got his visa on 11th Dec 2012 came to london in 2013 (26 jan) on tier 2 general visa through an umbrella company.He is working with same company till date and the license for the same has been revoked yesterday.We have started looking for new sponser i have few doubts if you can help me with that

1) What is restricted and unrestricted COS and in which scenario we need them.
2) We have not received curtailment letter how much time do we have to get the visa stamped considering we are planning for ILR after 2.5 years from now.

Please reply at your earliest convenience.

what your husband was doing was illegal and is not allowed under tier 2.

simple answer would be that restricted cos is needed for people applying outside uk and unrestricted is needed for people within uk. However there are exceptions that apply, like high value earners, spouse of tier 2 etc.

For your husband, he will need a unrestricted cos, however the company will need to carry out rltm unless his occupation is in shortage occupation.

From the day he receives his curtailment letter, he will have 60 days to leave the country or apply a new leave. The generation of this letter can take some time, which no one can gurrenttee. UKVI will send the letter to their most up to date address. If they dont have the correct address, the letter will be sent to older address and if u apply after that, you will be considered overstayer.

If you leave uk, u will have to serve 1 year cooling off time before u can apply again.

Thanks for your reply.

As you said we have 60 days to get new visa.My doubt is if i get my visa stamped/BRP on 59th day.Will there be any issues in my ILR,i read it somewhere that one have to find new sponser within initial 28 days out of 60 days to be eligible for ILR.

Hi

I don't think the 28 day thing is right. I just checked eligibility criteria for ilr and they have not mentioned anything like that.

Having said that can I ask you something?
My wifes visa are sponsored by her employer. Her employers licence is recently revoked but, we have not received any curtailment letter as of now. Can you tell me if we both are allowed to work as normal now and after receiving the curtailment letter?
