This is something that is not specified exactly in the immigration rules. But I suspect it will be a problem as it will otherwise contradict with the 200K route.

It will be useful for everyone if you can share the solicitor's reasoning behind this. Is there a specific clause that he/she is relying on. Or a previous case that was settled in court that sets a precedent.

if i switched to Skill Visa route, can i include (combination of visa for 5 years ILR ) the time spent on Tier 1 Entrepreneur to settle ?

Continuous residence
The 5 years can include time in the UK on another visa if it was one of the following:
Tier 2 (General) or Skilled Worker
Tier 2 Minister of Religion
Tier 2 Sportsperson
Tier 1, but not Tier 1 (Graduate Entrepreneur)
Representative of an Overseas Business
Global Talent
Innovator
