I'm applying for ILR next week, through solicitors (who aren't really getting back to me on this!)
Same employer for over 6 years, working holiday to work permit and now tier 2. The minimum wage for my job according to the COP is £25 000. My Certificate of Sponsorship was issued at £26 000 in 2009 (that was my earnings the preceeding tax year) so it's what my employer based their application at the time. My basic salary is £23k but I get extra payments, bonuses, etc to top it up.
My questions are:
- Will it affect my ILR application that my salary in 2009/2010 was £24 300 and £25 500 in 2010/2011 or does it have to be above the £25k COP recommended salary for the last 3 years?
- Secondly, will it affect my application that I didn't make the £26k that was on the COS every year, even though the company made some redundancies in those years and my salary wasn't declared to the Home Office as being lower than the previous years
- Would it be sufficient that I've earned around £28k gross salary for the last 12 months with payslips to prove this (Oct 2010 to Sept 2011)?
I would really appreciate any guidance in this regard, I'm starting to panic now!
