Tier 1 PSW getting Married to British Citizen

I am on a Tier 1 Post Study Work Visa which expires Jan 2013. I have been here since Sept 2009 doing my Masters which finished a year later. In August 2011 I married my long term boyfriend of 4 years who is a British citizen. Can I apply for naturalization/British citizenship now?

No. In order to apply for Citizenship you need to be free from immigration time restrictions (e.g. have ILR) which you do not have.

Given that PSW does not lead to ILR, you may wish to consider switching to leave as the spouse of a settled/British person on form FLR(M), which currently leads to settlement after two years in that category (but this may change later in this year).

Many thanks. Does it further complicate matters if my husband is resident in the USA due to his employment or is it enough that he is British? ie. does he have any residency requirements himself?

He has to be present and settled in the UK for you to qualify.
