Tier 1 PSW to Tier 2 General without CoS?

Post by littlemaiden » Sun May 01, 2011 6:59 pm

Hello, I currently work for a Telecoms Company and I've been working there for over 6 months. I am currently on a Tier 1 PSW visa and I want to switch to Tier 2.
My question is: what is this Certificate of Sponsorship thing?
Can I just apply with letter from Employer confirming that I've worked for them for over 6 months, payslips and bank statements without providing any Certificate of Sponsorship? This is because none of my 3 Line Managers seem to know what this Certificate of Sponsorship is or where I can get it from. Although I've checked the register of Sponsors list and my Company is listed there. Thanks.

That is strange, company being on sponsor register and managers no nothing of CoS, ask your managers to check with Head Office if they have one, or who is repsonsible for Sponsored workers, they would be knowing it.

You cannot apply Tier 2 without CoS because that is the way the company can sponsor a non-eu national.

Thanks for the prompt reply. The company is O2 with branches all over UK and we are only a small branch. So it's hard to find out where this CoS might be issued. Maybe there's any O2 employee here who has done this before who can help? Thanks.

Don't tell me that HR department in O2 doesn't know what CoS is and how it is to be requested / assigned! :?

Click on the link I have provided in my response above to understand what a CoS is. All the information your employer needs can be accessed from that webpage.

Hi sushdmehta, I have not contacted HR. Like I said in my previous post, I only spoke to my Managers in my branch. But now that you have given me the suggestion, I will contact HR to see if they can help. Thanks.

Also another quick question, stupid as usual. What happens if I get another job and leave O2 after a few months of getting my visa with them?

The new employer will need to assign you a new CoS, you will have to make a new application for Tier 2 leave .. and it is only upon grant of such leave will you be able to start work with the new employer.

Tier 2 restricts your employment to the named sponsor. Every change (of sponsor / employer) requires a new sponsorship.
