Tier 4 refusal advice

hi everyone,

firstly i need to ask your advice about the statement on the home office website regarding money:
Money needed if I have completed a course of study in the United Kingdom that was at least six months long in the past four months

the student did a 6 month course at the British Study Centre and it finished at the end of January 2009, she then started a 1 year course at the Interactive Language School straight away at the start of February, so she is currently 4 1/2 months into that course. My question is this, oficially, she finished the 6 month course just over 4 months ago, so does this mean that she doesnt qualify for this section? because in this section you only need £600 for 2 months to cover your living expenses. If she doesnt fit into this section then she basically needs £600 x 9 months visa or £5400 which is huge difference.


Her visa extension was 99% accepted except for the college fees money, she had £1200 in her bank acocunt so i hope that coverd the 2 month living expenses all she failed on was the money for the college course. So my second question is, can she pay for the college course in full and then appeal her refusal based on the fact that only 1 thing has changed and 99% of the application is still exactly the same?

If she pays for her college course in full i dont see how they can refuse the visa because she passed every other aspect, if we have to submit a new application we will, but i was hoping there is a way to save the £357 re-application fee. And will she need to redo all her paperwork like reference letters and sponsor letters and landlord letters? the home Office must have photocopies on their files so i was hoping the reapplication would be easier?

Her father has sent her £3000 to pay for the college course in full and pay for the reapplication. From what i understand she doesnt have to have the money in her bank account for 28days yet because that rule doesnt come into effect until the 1st october, i hope this is right because the money will only be in her account for about 2 weeks because we only have about 21 days left of the 28 days to reapply for the visa.
