Tier 4 Refusal for Gap in course more than 1 month. plz help

hi,

i have started the course pre mba, which is foundation course for 3 months and after this 3 months the main course MBA will start. the pre mba course start date is 18 november 2009, and the main mba course date is 02 feburary 2010. i have applied for extention of visa and they refused me on the fact that my course starts late and it have the gap for more than 1 month, i have qualified 40 points and i have got the right to appeal, but i dont know what to say,

i was thinking that i could have a letter from the college says, yeah this studying from 18 november 2009 is studying in this college for pre master in business administration, the pre master helps the student to enhance their skills before starting the real course, the pre master is important, every student should attend the course before starting MBA in our institution. if i provide this letter, would it be satisfactory for the judge. or please tell me what options i have or what i can do?,

because there no lawyer who have been experienced with this kind of issue. or if any one knows the student's best lawyer.
