Tier 2 Refusal

My friend application for Tier 2 was refused on the basis that the job role filled on COS required rate to be £15.88/ hr and on my COS the HR mentioned £29225. HO calculated by dividing that amount with 52 weeks which comes out £15.19 /hr. But I have an agreement with that I take at least couple of week holiday in addition to employer allocation and when he discussed with his HR about the rejection they said there is nothing in the COS to mention that.

He has been given 10 days to make an appeal. Do you think he should go for an appeal or ask the employer to get the new COS.

I would appreciate opinion and views to help him out.

I am in same situation, i am not appealing as it is like appealing against a mistake u made and now you are trying to justify it. Though the advanatge in your case is that difference between the rate of pay required and paid is very small, so you might be able to get through.

But if your employer got more cos they should issue a new cos and the employer should rase the pay rate and apply again. This is my opinion and views but its always good to consult good solicitos asap
