I had given a job interview in October end and got selected along with other one candidate from the US. I was advised in Mid November that I will have to wait till January 15th to start the job, as the company will be applying for a sponsor license and normally takes about 2 months to get it. I recently got a call from the HR of this company that their license application had been refused last week and they are in the process of re applying. They have now advised me that they are looking at a months delay and start date could be mid feb - early march. This is very disappointing.
I was speaking to my friends and some of them said the company cant reapply as there will be 6 months colling off period? So I called the HR again and advised this and she checked with their lawyers and they said no as its not mentioned on the refusal letter. And she told me they been refused for 2 reasons
1. They did not have a system to monitor staff clocking and out- Appendix D
Reason being the Home office visited their new office in southampton and they had a new office set up for the new branch from Jan 15th. But had they visited the head office, this system was in place. But in the re application, company has mentioned the new clocking in and out system is placed in Southampton branch as well.
2. One of the guys was pre selected and HO confirmed the company had done RLMT as per Appendix D. - This was the guy from US, his position had 6 applicants in total and they were looking for 7 specific skills relating to senior software developer. But only the US guy had all the required 7 skills, the company interviewed him via skype and got his details and applied for his COS with the sponsor license application. So i am assuming, because others were not selected for interview, this was assumed that he was pre selected? Refusal for point 2 done as per Annex 1 i and m.
The letter doesn't say the company has a cooling off period, but it states theres no right to appeal.
Please advise if i am correct in believing the HR that we could re apply with the above 2 straight away?
