Tier 2 sponsorship during a redundancy process

Hi All,

The company which I work for is going through a redundancy process and I have been classified as 'at risk'.My senior managers have unofficially told me that I should be fine i.e. I won't be made redundant.

My Tier 2 visa is about to expire on Dec 1st 2014 and the redundancy process would finish only around mid December.

The company has told me that they are willing to apply for an extension early November, while I am 'at risk' during the redundancy process. Can anyone please tell me if there is any precedent or rule which will prevent me from extending my visa during the redundancy process?

The redundancy process is not an immigration issue. For your visa extension all that matters is whether your employer is prepared to assign a CoS. Even if you have a CoS, and make a successful visa application, your employer can cease sponsoring you if they decide to make you redundant.

Can you please keep this post updated with what happens ? There are redundancies occurring in the company I work for too, and there is a chance the worst could happen.

If I were you, I would look for other positions as well to be safe.

I would recommend understanding the redundancy rules, as with my company people made 'at risk of redundancy' usually have a month working for the company then are no longer employed. Insist on the new COS so they feel they have invested in you further - you don't want to risk your current COS expiring - then that makes it too easy for them to let you go.

@boarder- not sure I understand what you mean by a new COS? -please explain.
