Tier 2 switching into Tier 1 PSW

I am currently on Tier 2 (general) and my contract is ending so I am considering applying for Tier 1 PSW to extend my stay in UK.

I am aware that I cannot switch to PSW from Tier 2 (General) when I am in UK.

My question is, can I just go back to my home country and apply for PSW there? Will they refuse me base on the fact that I am currently on Tier 2? It is not clearly specified on their guidance document.

The date of award of my degree is in Aug 09 so I've got until July 10 to get it sorted.

Thanks for the reply~

So that means I can go ahead and apply for PSW in my home country as long as it's within 12 month of the date of award am I right?

one of the key requirements for psw is that you got your degree within last 12 months...have you?

PS. use calculator on UKBA site to see if you have enough points. Also, psw is a one off visa. have you ever applied for psw before tier 2 visa? if yes, there is no way you can apply for psw again. if no, then check if you have enough points and then apply in confidence

I have checked with the UKBA calculator and I have never applied for tier 2 before.
I have finished the course in June and the date of award of my degree on my transcript is Aug. So I have got until July this year to get it sorted, I guess....

What was the outcome of your case? I am in a similar situation. I want to change to PSW from Tier-2 and well within the 12 month requirement and all other requirements.

Should I have to apply from outside the country??? Can't I apply from here to switch to this category?
