Tier 2 to Tier 1 visa dependant

Hello,

I am working in UK on a tier 2 visa and my Husband is on Tier 1 visa. I am planning to switch to Tier 1 dependant . I guess, I have to go outside this country to file this dependant application.

I have a few more questions around this.

1. My husband's visa is expiring in another 8 months. Is there any restriction like I cannot make a dependant application in last 6 months of expiry?

2. If I am continuing in Tier 2, can we make the extension application together from here? Do I need to still go outside this country before filing the extension?

Just to confirm, So I can switch myself to Tier 1 dependant from Tier 2visa from within UK itself if i am applying along with my husband's extension application.

Switching (change immigration category) is different from extending (applying for further leave to remain in the same category).

Your Q1 is regarding switching and Q3 regarding extending. Don't mix the two!

My husband would be applying for extension after 6 months. Can I include my switching application (Tier 2 visa to Tier 1 dependent) along with his application? . To be clear, I am having some medical issues and am not in a position to travel outside this country. hence I am asking you an option to switch to Tier 1 dependent from with in this country.

You cannot switch from Tier 2 to dependant of Tier 1 (General) migrant (319C(h)). This requires entry clearance from outside the UK.

I have a similar question. My name is Dhivya. I worked in the UK on Tier 2 until Nov 2010 for 2 1/2 years. During May 2010, I applied for Tier 1, which was not approved as homeoffice has not considered my Indian salary on Tier 2 and apparently fell short of points due to lack of funds. I have returned to India.

My marriage is now fixed with my friend & colleague in the UK who is working on Tier 1 general visa. I am happy to inform you that marriage is on 27th Feb. And I want to apply for Tier 1 dependant visa after that in March 1st week, 2011.

Concerns & questions:

-1) You think my earlier Tier-1 application (not approved) would be of any concern while I apply for Tier 1 dependant ?

-2) While submitting the paperwork, do I need to provide any documents (previous application details, payslips, bank statements etc) related to my stay in the UK along with my spouse's ?

-3) My spouse's Tier-1 General VISA is due for renewal in August 2011. Will that cause any problem for me to obtain the Tier-1 dependent VISA (as it will be nearly 5 months to the renewal date when I apply) ?

Would highly appreciate your assistance on this.

I have one more question. My Tier 2 visa is valid for anothjer 3 years. If I am switching to Tier 1 dependant, Will the Tier 2 get cancelled?

I am in the same situation as you were some years back.
I came to UK on a work permit for 5 years and it expires in Aug, 2012. My husband is on Tier 1 and it expires in May, 2012.
However, due to the current employment market, I will lose my job this month and thus my work permit will be cancelled.
I am planning to go back to India with my infant son and apply for dependent visa on Tier 1, for both of us.
But since my husband has less than 5 months of valid visa left, will I still get a dependent visa for myself and my son - or is there any restriction of minimum six months required on visa ?
