My visa is due to expire April 2015 and i have a few queries

1) As i am renewing Tier 2, am i right in saying that i will only need the unrestricted COS and also my employer will not need to perform the resident labour market test?

2) My employer checked their SMS portal and found that they have not received any annual allowance for unrestricted COS in the current year. Would it be possible for them to make an emergency request for additional COS before Apr 15 (which is the next renewal date) or can they only wait until April for the next annual renewal. as my visa is due to expire in April 15, it would give me more comfort knowing that a COS is available to be assigned to me rather than leaving it till last minute.

If you are extending with the same employer then as you will only need unrestricted COS from your employer. Assuming you are doing the same job you will not need to RMLT and automatically qualify for the maintenance and English language for T2 extension application.

For your 2nd questions- Usually employers can apply for additional COS anytime through SMS system it will take about 3-4 weeks to be processed. However as no COS was allocated for the year, I am not sure if it is the same procedure. Best to wait for the confirmation from a senior member to be sure.
