my university has reported to UKBA about my poor performance without letting me know. they didnt even informed me. now i recieved a text message from CAPITA on behalf of Home office stating "OUR RECORDS INDICATES THAT YOU MAY HAVE NO LONGER LEAVE TO REMAIN IN UK. PLEASE CONTACT ON --------- FOR FURTHER DETAILS" I didnt received any sort of email/mail correspondence from home office as well as my university that they are sending my complain to UKBA.
i contacted CAPITA via email the they said that my leave to remain was finalised till 11th january 2014 and i was notified via email in november 2013.
but to be honest, i didnt recieved any sort of email, or written letter because i daily check my email and junk folder as well.

can anyone please help me ASAP as i have got no time

Because i was not informed by UKBA or my university about this decision of curtailment by any means. I didnt recieved any email. Any letter from the UKBA/university about this. Only yesterday i recieved this text msg from HOme Office for the very first time. How can they do this without letting me know?

Contact Home Office for a curtailment letter. On your curtailment letter they would mention by which date you could send them a new application. Without that letter it will be quite hard to get admission in any where. Contact your University as well to find out when they made the report and why they did not let you know about it.

You need your latest academic progress report from your University as well.

I agree with your point. But the problem is both the uni and ukba didnt informed me abouy this decision by any means of communication. I m going to uni today to discuss this matter

How do you know that your University has reported you to the UKBA? There have been instances where CAPITA has relied on out of date information. They have even sent texts to people who have been granted ILR. You better make sure that this is not the case here.

Yes I am going to see them daily. In the mean time, i have been recieving calls from capita asking for my details like full name address etc etc. i said i cannot provide you any of my details because i have contacted my university and they are dealing with the UKBA regarding my case.
basically, i was withdrawn from the course but then the issue was resolved by the head of my university. and i was doing resits. That was resolved verbally but the database of the university was not updated with this decision for me and thats how i was reported to UKBA.

so the problem was with the university database. and today i requested the head of my University to send an email to capita stating that "THERE MAY HAVE SOME PROBLEM WITH OUR UNIVERSITY DATABASE DUE TO WHICH THIS STUDENT WAS REPORTED TO YOU. AND WE ARE TRYING TO SORT THIS OUT ON PRIORITY BASIS"

and finally he did it just a few minutes ago and sent me a copy as well.

the university is still asking me to leave the country and in the mean time they will sort this out and send me a new CAS letter. so i have to re apply my visa from back home. which i think is not a good idea.

my last day of living in UK is 7th february. So I am applying FLRO on basis of my case that the mistake was from university but they are not sorting this out.

any advise please?

How long it will take you to complete remaining of your course? If you are staying after 7 of February in UK you will be an over stayer. It seems like your Uni already have contacted UKBA and things are not positive and that's why they are advising you to go back to your country and apply again.

I am just wondering if they have withdrew your sponsorship and reported you to UKBA, they can actually also make a report that they again reinstate your sponsorship. And as long as they have the proof of it, you should be fine. So you can ask them whether that could be done or not.

2 years of my course is remaining. I have to pay them 8000 pounds for my remaining course which starts in june 2014. Right now its holidays or term break til end of may. They are advising me to go home. Because they dont eant me to be overstayer. If i apply FLRO here then at least i would be legal in thi country and i can deal with my case. What do you reccomend. Should i leave the country by 7th feb or apply FLRO by 7th feb to stay legally in this country while thia is sorted out?

You may not be qualified to apply under FLRO. Also if you have applied for FLRO your Uni might refused to issue you CAS in the future. So talk with them about it, also ask them if it would be possible report you and reinstate your sponsorship.

Lawyer asked me to apply flro and be legal here then in the mean time when the issue is sorted out and i get a cas letter from university then i can withdraw the flro application and apply a fresh tier 4 apolication. Is this possible?

If your lawyer told you in that case you can apply FLR(O), my knowledge is less regarding that. But make sure with your University that in future they will issue you CAS for your fresh application. Also inform them that you are applying FLR(O), and ask them what will be your status with them.

Why do you want to make your case EVEN more complicated by applying for FLR O? On what ground will your case (FLR-O) fall under? Your situation is NOT exceptional !! Your University who is your sponsor have advised you to return home and they will sort it out. If you go ahead and your FLR on compassionate ground is refused (90% chance) you will find yourself in a mess..No CAS will be issued to you because HO will hold your passport and then what will you do? Your lawyer will only continue to milk you until with you or HO give up.

Please follow what your University said.

I dont need flro visa. I am applying this just to get time and at least be legal here ao that i can get time while the university sorts out the issue and give me a new cas. Then i will apply a fresh application by withdrawing the flro application.

There's a difference between you not wanting and applying for it. When you sign the FLR-O form you have given your consent. The FLR-O application turnaround is faster now (2014) than last year -2013(Check FLR-O timeline thread) , applications are being completed within 3-6 weeks now.. So if you plan on using that to buy time, you better think twice.. Once you send the form off, you have no control over the situation any more.

Sir i dont take any offence. This forum is to take advise from seniors and thats what i am doing. I know a person who applied for flro on 8th december and his application is still pending.

You may be able to buy some time and not overstaying but if your University does not issue you CAS at that time you will be in more trouble.

I hope you have discussed your situation with your Uni and what you are planning to do.

Sir I have planned to stay here finally and apply FLRo on friday. Because i cannot deal with them while sitting in home country. And here at least I have more chance of sorting out this matter as compared to if i go back home. If i go back home and they didnt sent me the new cas to re apply. My future would be finished. While staying here. At least i can fight with university to aort out my issue asap. And secondly. On flro. When i will apply it. Then untill i have done the biometrics. My application wont move further so i can stretch upto two months with this. I know finally its decision comes negative. But at least i would be staying here legally and sort this matter out with my university. As soon as i get the new cas. I will simply withdraw the FLRo application and apply a fresh tier 4 application on the same day. The FLRo fees would be refunded back to me.

Who told u that if u withdraw flro application they will refund back your flro fees??????????
