I came into the UK on a HSMP visa in 2007. I started living with a British citizen and married her in 2008. I renewed on a Tier 1 visa in 2009. Under the old system, I would get an ILR after 3 years in the UK. That has changed and I cannot apply for ILR based on marriage to my spouse since my original visa is not as a spouse.

What options do I have to enable me apply for ILR as a spouse in this circumstance?

You would have to switch on form FLRM and apply for ilr after completing your two year probationary period.
