Tier 1 visa refused because of maintinace fund

hi my tier 1 hsmp refuesed on maintinance fund, i have attached letter from FSA registered saying that they owe me funds more than 90 days prior to application, they refuesed saying though company is FSA registered but cant hold money for other services like investment securities, but they can do for the services they provide as this company
is insurance mediator, what would be the reply?

secondly can i use my company statement for my maintinance funds, as i am the sole owner and director of my limited company,

need answer for these two its urgent

this depend upon companys objective and hard to prove

secondly can i use my company statement for my maintinance funds, as i am the sole owner and director of my limited company,


no , company is separate identity from its shareholders

need answer for these two its urgent

hi
my case is gone for JR, as it was refuesed on the basis of Maintenance funds, as i provide a statement from FSA registered institution, but Ho saying though its registered with FSA but can't hold client money, and i have found similar case accepted by HO i.e ABC applied for tier 1 visa and in maintenance funds he attached FSA registered frim letter but cant hold client moeny but HO issued him visa, can i use that as a reference and send the name of the company to HO,

and secondly i got same type of saving overseas with insurance company and that is regulated by home operator in Pakistan ( SECMP), they having my funds for the last ten months that include 90 prior to applicaiton, ( as i have read that Financial Institution registered by home operator)

and thirdly if we read the guidence notes it clearly says that letter from FSA registered firm say that they having funds for 90 days, name of the applicant, account number, date, it never says that whether it can hold client money or not, my made grounds on this point.

and can we communicate to HO or not while they file there answers in the court, as the matter is gone for JR,

and how section can help me as i am living here for five years with family and running business,

and can i switch to Tier 4 student visa while my case is gone for JR,
do i need to withdraw JR appeal or i can go for that,
as my visa expiring on 13/11/2011

Salam Abbasi,

I am in the same boat, i got refusal on the same basis that the FSA authorised firm in not eligible to hold these funds, and they refused my case on the basis of maintenance. i hope your case will be sorted out now, could you please share the outcome of your case. did you win the judicial review.
will you suggest me to go for the judicial review in this situation or not.
Thanks in advance for your help or help by any other senior member of forum. i am really desperate and disappointed and all your help will be greatly appreciated in this regard.

Hi i can understande your situation, i been through this, and its almost one year now, I knocked Hight Court doors & still waiting for the hearing, positive sign is that High Court accepted appeal for hearing, the point i raised was the in notes or guidence its only mention that insituation registered with FSA never mentioned can hold or not hold money, and also referred to Pankina case, let see what happen, did you consult any solicitor, my email is t_abbasi@hotmail.com
