tier1 dependant - payslips reqd: yes or no

Does the person on tier1 needs to be working and should have payslips in order to apply for a depedant visa for his wife.

Could you please advise

There is no requirement for the Tier 1 main applicant having to have a job in order for the dependant to apply. As long as the main applicant is sticking to his/her conditions, there is no reason that an application can be refused even if the main applicant doesn't have a job. (In my case my dependant's visa was approved at a time I had no job in the UK, but then I hadn't moved over yet, but at no point was there any requirement to prove that I am working for my dependant's application).

To be honest, I am a IT Contractor. I got a contract till Jan20th 2012. Getting married on Jan27th. I want to apply for her visa immediately. on 2nd Feb 2012. The only issue is I can show my past payslips for the last 3months but not sure if I show it will the caseworkers think I am still working and try to contact my clients.

What do you think the best bet would be??

Hi Canon - are you the director of your own Ltd or with an umbrella co?

Either way I would say that my answer would involve getting an accountant's letter to back up what you provide - but I do obviously have bias here being an accountant and that so hopefully someone else will come along and give a more independent viewpoint.

Why??? I don't understand why people want to go out of their way to provide documentation which is absolutely not required. Not only will you waste your own time, but also the poor soul who have to wade through all the documentation you provide which is not necessary.

What they care about:

* Does the main applicant have a right to be in the UK?
* Is the relationship genuine?
* Can they sustain themselves using their maintenance funds?

There is NO requirement to prove that the main applicant is working, there is NO requirement that the main applicant is earning a salary and there is NO requirement that the main applicant to send in proof of earnings.

Don't waste your time...

Thanks for your advise Mulderpf. If I am not providing any payslips with the application. Can I leave 7.14-7.19 fields blank or N/A in the Tier1 dependant application form.

If I am getting married last week of Jan. Can I apply for dependant visa immediately, I mean in 2-3 days.

My Visa expires Feb 2013. I am getting married in Jan 2012 and wants to apply for visa in Feb 2012. Do we have any rules that Tier1 visa holder should be having a visa which is more than 12 months

Seniors please advise!!

The truth - just put whatever the truth is, you do not need to back it up with documentary evidence. If you're working put it there, if you're not, put it there. Don't leave it blank.

The same way that you declare that you don't have any criminal convictions, doesn't mean that you have to send a police clearance certificate to prove it, they are happy for you to just provide the information without bogging them down in additional paperwork. If they want anything extra, they can ask for it.
