Tier1 dependant visa expiry linked to main visa ?

Post by raj_ss » Thu Aug 25, 2011 10:32 am

Hi All,

I am a tier1 visa holder and reached UK an year back. My wife has a tier1 dependent visa but she is currently in India.

My visa expires on 15-Oct-2011. Now I want to extend my visa by 2nd-Sept through PEO(because on contractual obligations, else will be out of job). My wife is travelling by 3rd week of September only.

My question is when my visa get extended will the dependent visa get cancelled automatically?.

In nutshell " will extension of tier1 main applicant visa affect tier1 dependent visa when dependent is outside UK"

Appreciate all your help.

Thanks

It depends on if you are extending because your leave is expiring and on if your dependant has leave granted in line with yours. If her leave is not set to expire it will continue to be valid until it does expire while your have a valid leave as a PBS migrant.

Thanks very much for the quick reply . Does that mean my dependent
can enter UK (on her dependent visa) and stay till the visa expiry irrespective of whether my visa is extended or not.

Her leave is set to expire when your leave expires. Obviously if your leave expires on a certain date then hers will expire also.

If you successfully extend before her, then her leave will be out of sync with yours. She shouldn't have problems entering the UK before her leave expires, as you will still in the same category. She should also extend after she returns, before here leave expires.
