Tier1 Ent 50 K extension related general quries

Post by Meesha » Thu Feb 25, 2016 3:00 pm

Dear Forum members,
Please let me know
1: For how long maximum one can stay outside UK while holding Teir1 Ent visa? I know one cannot stay 180 days in one year consective.
Is it also the case that one can not stay total 180 days in parts outside UK during 5 years period of Tier1 Ent in order to qualify for ILR. (For example 2 months each year of 5 years visa time)
Is it fine to stay concective 90 days outside UK

2: Is it necessary that you apply for extension 28days before expiry of your current visa or you can apply 2/3 days before your leave of current visa expires. In my case i hired one employee during last year. If i apply for extension 28 days earlier to my visa expiry then i cant provide her last month payslip.
Please help me with the above quries

You cannot be outside the UK beyond total of 180 days (consecutive or not) per year of stay, if you want to qualify for ILR. So you can be outside the UK for 2 months a year or 90 days a year without any problems, as long as the total per year does not go over 180 days.

It recommended to apply 28 days before your visa expires, however you can apply later until before the expiry date of your visa. You can even apply up to 28 days after the expiry of your visa but in that case you become an over stayer as your visa will not be extended under section 3C, so it is not a good idea.

the day you leave and the day you return are considered 'in the UK'

Relevant if you do a lot of short travel to the continent for example

Thanks Zimba88,
Can you please tell me how many total days one can stay outside in 5 years on T1 Ent visa? I mean like ILR on long residence requires u not to exceed 540 days total in 10 years? Is there any ouside stay limit for T1 Ent visa too.

I don't think there is such a limit for the 5 years route. Just the 180 days limit rule applies per every year of stay in the UK.
