Tier1 to ILR + Dependent (Married/Joined April 2014) - Help

Post by DenKan » Thu Jan 08, 2015 7:14 pm

Hi Experts,

I'm learning a lot from this form for rest of my application. I have a question which i cant find anywhere in this form. Maybe im not using the right keywords.

I got my T1G on Feb 2010 and Ext Feb 2013 until 2015.

I recently got married last year on Feb 2014. My wife joined (first time entered UK) me on April 2014. She has not been in the country for 5 Years . The new visa rules since 2012 says any depended from 2012 needs to be in the UK for 5 years which in my case my wife will need to get extensions until April 2019 i believe. Correct me if im wrong.

I got few questions:

Q1. I'm using the SET(O) form for my application and have filled the dependent's details. is it OK ? Or is there any other application form i need to fill for her separately since she has not lived here for 2 or 5 years?

Q2. Since she is new here in the UK and did not work, we never opened a bank account or even applied for National Insurance ( My fault) Bad . For the cohabitation evidence i have got

a. Internet/Phone Bills from 06/2014
b. NHS Registration and Letters 05/2014
c. Utility Bills - Water/Elec/Gas (same provider - so all on one statements) - for few months
d. Marriage certificates
e. UK and holidays pictures taken together.
f. Tenancy Agreement - renewed on January 2014 with her name on it.
g. Council tax lost - new one shows January date (isit ok)?

Q3. During my 5 years in UK I have worked for 6 months with one employer and the rest 4 and half years with my current company.
When requested for the absence for 2 annual leaves taken outside the UK my ex-employer replied it will take a long time to get this records but did not mention that it cannot be found or they don keep the record. But the HR is taking long to provide or reply. Will these emails to and fro help the CW to understand i have trying chasing but did not get the letter? or whats your suggestions?

Q4. Regarding English Language. I have done my degree in UK and also I have done my BS and MBA abroad and have UK Naric to confirm the course is equal to UK etc but i did not apply for the English cert from them. During my initial T1G application on 2010 i did not give anything regarding English but did give them all my degree applications and UK Naric letters and certificate. I also have a letter from the university of BS that the course was taught in English on a university letter headed paper.

Will i need to now prove my English knowledge here or am i in trouble. What should i do to prove and bridge this gap if exist?

Many Thanks for the time and energy for this help of yours.

Regards,

Dencan

Correct

you need to fill Set(O) Form for you and Tier 1 G dependent extension form for your spouse

In Tier 1 G dependent extension you don't need cohabitation documents

Present those absence letters which you have if any missing doesn't matter.

UK Bachelor/Master or PHD degree certificate is sufficient to prove your english language requirement.
