Tier2-Got COS,Present Employer Notice and Visa HELP Pls!

Hi All,

I am presently on a work permit till 2013 and I got an offer from a different employer from same field. I have recently got my Sponsorship Certificate from my new Employer.

I have to give a 2 months notice to my present employer before leaving them. I wanted to give them this notice once I successfully get my new Tier-2 work permit from the new employer.

My question is: Can I book my in person interview or post the application before giving the resignation letter to my present employer? What will happen if after 1 month I get my new permit from the new employer, will I be able to work with my present employer?

If I can get an in-person interview, can I ask the HO people to start the new permit from a later date?

Please can someone help me in this regard, as to what should I do!

PS: I did searched around on this forum about this specific issue but could not get an idea, about when should I hand in my resignation letter?

1. U current employer will have to inform the HO that u wish to leave the job.
2. Once they informed the HO then u can apply with the new employer but not before informing the HO about u termination of the job with the previous employer.

Hi Ash,
Thanks so very much for replying. In most cases in this forum, I have seen people suggesting that - One should have the entry clearance first and then resign from the job, so as to avoid being in strange position of having no job, if the visa is refused.
I would further add:

In my Certificate of Sponsorship received yesterday, the start dates of my job are mentioned as : 1st mar 2010 which is 1 month from now. The thing is even if I give my resignation today, I cannot leave my current employer before 2 months till April 2010. So how will Home Office consider this?
In the document you linked there is a mention at :

When to apply
163. You must apply within three months from the date your Certificate of Sponsorship was issued. You must also apply no more than three months before the start date on your Certificate
of Sponsorship. If this is not possible, you should contact your sponsor.
164. If you are applying from inside the United Kingdom, you should apply before your current leave expires. If you do not, you will be classed as an overstayer, which could affect any future applications you make.


It doesnt say if visa has been granted, will I be able to continue my present employment? Should I apply for my entry clearance asap and then once I get that, give my resignation. The points which you suggested, I cannot see them anywhere in the guidelines or any other document? From where did you get that information?

1. I think u have not read the guidence in full details start reading form PAGE 17.
