Hi, I have a colleague, who I help with her the Tier 2 general application, but there is a mistake that was made with an RLMT. The code of occupation is 2472 and according to new codes of practice the minimum salary for the experienced worker is £ 23,000. However when RLMT was conducted, the company erroneously used old codes valid for 2014-2015 (the old one is still on the gov.uk website, hence it is easy to make a mistake...), where minimum salary was lower, as a result they advertised salary of £22,000. However the company is willing to increase the salary to £23,000 to make sure it complies with the new code requirement. The RLMT is now completed.
Does the company need to conduct a new RLMT for the post or can they request the restricted CoS now?
One though is they reduce the hours to for example 35 hours a week, so that the pro-rata salary is compliant with the one advertised in RLMT but still complies with the code. Number of hours were not mentioned in RLMT at all, just a full-time job.
