Tier2 : Salary in Employment letter greater than in CoS

Post by honest_cheat » Fri Nov 18, 2011 7:12 am

Hi Guys,

I received a CoS under Tier 2 (General) category which states my salary to be 26K anually but the employment letter he sent to me is of 40K anually. Now I have to apply shortly for visa with that CoS.

Will this have any impact on my chances of getting the Visa  . Is this an acceptable case where salary in the offer letter can be greater than in CoS ??

Appreciate your quick feedback in this regard.

why did they state 26 on the CoS then? Which salary is true?

there is a descripency here which you should ideally resolve ASAP.

but immigration-wise, as long as 26k is the minimum-required salary for the job you have applied COS for, then it should be fine. you can proceed to making tier 2 app.

It is acceptable to have higher salary than what is requested in Code of Practice under 'appropriate salary'.

Thanks a lot 'arsenal49' for your quick feedback.

Actually, the job published by my employer is of Programmer ( Job type 2132 IT, software professional) and salary published was in the JD was 26 K.
But the ultimate settlement of salary with me ( as per my demand) was 40K. Now , the employer suggested that I could use the 26K CoS against 40K offer letter and gave the same comment as provided by you.

Dear 'The Station Agent' , after hearing my case if you have any comments or feedback or you see any issue here, you are most welcome to express that.

wait for other people to reply but... your sponsor can always put in the sponsor note on sponsorship management system that you are likely to be getting 40k once you start working on tier 2.

you will be mentioning 40k in your tier 2 application and it wont match up with what sponsor has written on your COS which may prompt further checks from ukba i.e. delay...

so remedy this at your earliest. my two cents on your problem....
