Tier4-Student visa refused

Hi There,
I need some help. I came into the UK in 2003 and was granted student visa for 1 year. Since then i have renew my student visa, each time was granted 1 year until last year 2012, based on courses i have done like Certificate, Diploma, HNC and HND. I never completed my course to do a full degree. Before my visa expire last year, i got enrolled into MBA course at Derby university and was accepted. I sent my visa for renewal in September and last friday , i got a letter from UKBA saying i got refused due to not having a degree. I have right to appeal.

On the other hand, i have 2 children who have been in the UK for 7 years and in January 2013, they were granted discretionary leave by UKBA towards route of settlement.

I just want to have an idea whether i should appeal for my student visa or play safe and submit a fresh application and apply as dependant on my children visa.

In August this year, i will qualify for 10 years long residency.

What do you mean by this? How did you manage to get CAS from University?

Its actually University's responsibility to assess your eligibility for the course plus check your academic progression.

Hi preeti41,

You should have asked the university to mention your last progression report in CAS.Whenever one gets enrolled in a higher course, college or university ask for their previous qualification.

I think if you do not follow your right of appeal and make a fresh application it may break your continuity for the long residency.
