Time to apply for my ILR - Related queries

Post by Mouni3 » Mon Nov 16, 2020 7:42 pm

Hi All,

I hope everyone is taking care and keeping safe.

I completed my five years in UK beginning from September 2015 to September 2020 under PBS dependent(Where my husband got ILR under 5 years Tier 2 general route and at present he is a British Citizen)

So I am about to apply for my ILR where I have few queries about my ILR application. I hope you will help with my queries below. Many thanks in advance for all your valuable support.

Q1. I am applying for my ILR application using the following link, Is that the correct link? please suggest
https://www.gov.uk/settle-in-the-uk/y/y ... ier-5-visa

Q2. I have passed my Life in UK test in the year 2017 so I am hoping it is still valid. Am I correct?

Q3. In the process of filling my application I got a question asking as below
Has your husband name sponsor agreed to certify your maintenance?
Where I said No and I got questions for Maintenance.
Do we have to show maintenance of £630 for ILR application as PBS Dependant? I believe not but just want to get clarification on this(Because I cannot proceed further without ticking checkbox for funds maintenance of £630)

1) You need to apply on SET(O)
https://visas-immigration.service.gov.uk/product/set-o

2) Yes

3) I am not sure if you are filling the right form. Follow the link as above for right form. You do not need any maintenance or income requirements.

Hi,

First of all, Thank you so much for correcting me and re-directing me in right direction. Now I am filling correct SET O application form for my ILR as PBS Dependant under Tier 2 General

I have few queries while filling application form, Particularly under documents section could you please help!!

Many thanks in advance.

1.
Which visa is Mr HUSBAND applying for or been granted?
Choose the route that Mr HUSBAND has applied for or been granted, even if their application is still being processed.

Tier 2 (General) visa

Do you have one of these reference numbers for Mr HUSBAND?
(Required)

Yes, I have their VAF number ---->Is this the BRP reference number?

Yes, I have their GWF number

No, I do not have a reference number for them ---->I have selected NO option, because we are not sure.
2.
The Home Office will check that the information and supporting documentation from a bank or utility company that you supply as part of this application is correct. You must download, sign and return the following declaration to confirm that you consent for the Home Office to request verification checks:

Declaration of consent for the Home Office to request verification checks

You should download and print this declaration now. A copy will also be available to download once you have paid for your application.

I will provide a declaration signed by me to confirm my consent for the Home Office to request verification checks
On the above consent form, after my readings on various other posts...I understood that main applicant should fill Part 1, Part 2 and Part 3 should be filled by ILR holder(If the applicant is not working also to be safe side) and also the same consent form should be filled for child and signed by parents.

Here my query is, in my case I am working and not completely dependant on my husband but my husband pays Visa fees, mortgage etc. Also the utility bills like Gas and Electricity is on both our names whereas we both have individual bank accounts and we don't have a joint bank account.

a) So who should fill which parts of consent forms? Please suggest?
b) If my husband is sponsoring me and signed the consent form. Do I have to submit my husband bank statements also as part of supporting document evidence?
c) Do I have to submit my P60/Payslips?

3. Regarding co-habitation documents, we only got two letters which are annual bills not monthly bills for council tax which is on both our names. Is it sufficient?

Finally, Do we need passport photographs to keep ready like paper based application or not?

Please help me in answering my above queries and many thanks for your valuable advise. Much appreciated.

Take care and be safe!!

This is an “IF” question. VAF and GWF is not same as BRP number. So ignore

2.

Correct. Part 2 and Part 3 tells you when to be signed. Your husband will sign if that applies to you. Same for the child - but Part 1 for child is signed by the parent and Part 2, 3 if required

Here my query is, in my case I am working and not completely dependant on my husband but my husband pays Visa fees, mortgage etc. Also the utility bills like Gas and Electricity is on both our names whereas we both have individual bank accounts and we don't have a joint bank account.

You will sign Part1, Husband signs Part 2 &3 for you
b) If my husband is sponsoring me and signed the consent form. Do I have to submit my husband bank statements also as part of supporting document evidence?
No
c) Do I have to submit my P60/Payslips?
No

3. Regarding co-habitation documents, we only got two letters which are annual bills not monthly bills for council tax which is on both our names. Is it sufficient?
You need to provide from 3/4 different sources spread evenly for the last 2 years i.e. every 3/4 months (quarterly). Ideally joint names but you can use any document in solo names but same address to top it up also

Finally, Do we need passport photographs to keep ready like paper based application or not?
No

Please help me in answering my above queries and many thanks for your valuable advise. Much appreciated.

@CULLINAN
Hi,

I hope you are doing well.

I got couple of queries which I am hoping you will help with...

1. Possibly this is a repeated question, In ILR Document Checklist (Please see below pic) I have BOTH Consent Form and Declaration Form options to be checked but I am only able to download Consent form which is of 3 parts and nothing I can see related to Declaration forms. So I am thinking Consent Form is only one which I should submit with my ILR application and Declaration as we already confirmed while filling online application. Is my understanding correct please confirm?

A) Consent form for the Home Office to request verification checks on (husband name) for joint accounts or third party support.
B) Declaration signed by (husband name)) to confirm consent for the Home Office to request verification checks

2. I am submitting my documents and my husband co-habitation documents which covers the period of two years includes Council Bills, Water Bills, Electricity Bills, GP letters, HMRC and DVLA documents. Do I still have to submit my bank statements or not needed? Please confirm

Many thanks in advance.

1) Correct. Consent form has 3 parts only. Declaration is at the end of the online form itself.

2) You have enough documents. You can use “bank statements” as evidence for cohabitation also if you wish.
