Time spent outside UK.

Dear All,

My query might have been already discussed but I am not sure.

I am currently working in the UK on Tier-1 General. I am eligible for ILR in June 2014. I got married in Dec 2009, even since my wife lived with me in the UK on Tier-1 dependent Visa.

We haven't spend any major time since 2009 outside UK apart from normal month holidays every year.

She is pregnant and going to India and will be in India for next 7 months. Will this affect her ILR application?

It will be appreciated and helpful if some one advise me on this please.

I think you have overlooked one important bit - your soon to be born child.

If the child is born in UK: after you get ILR, your child will simply 'register' as a British citizen, and get his/her British passport.
If the child is borh outside of UK: it is not too complicated, but not as straightforward as being born in UK.

If the child is born in UK: get child's passport from your native country. Get the child's visa as your dependent from within UK. This is much easier (less complicated) than doing the same from outside of UK. Then the entire family can travel hassel free.

These are just my experience.

Regarding your wife, she should be fine as long as she has completed 2 years as your dependent in UK before applying for ILR.

I do understand your point of child born in the UK, but it is little difficult practically as lot of things involved family wise. As far we all getting ILR, it is satisfying I would say for juts now. I do understand your point tho and I must appreciated I did overlook in to.
