Tier1 dependent company owner

Hi
One of my spouse's friend has started a company for which my spouse is the partner. I believe this is absolutely legal as tier 1 dependent has the same employment rights as a tier 1 applicant? please can you confirm? also could this be a problem during extension application processing?
