Hi guys,
could you please clarify me when can i apply ...

HSMP visa granted 14/9/2007
Entered Uk on this visa 4/10/2007
Extension on Tier -1 to= 14/9/2012

My assumption is i can apply 28 days before my 5 th anniversary of visa issuence ? If this is correct then i can apply on 17/08/2012 ( which is exactly 28th day prior to expiry ). Can some one plase clarify as while reading other post some one posted Entry date should be counted for 28 day rule.

Yes you can apply since you have entered within 90 days and you visa is expiring after 28 days. There is complete misunderstanding among our friends that your 5 years start from visa issue date. If your visa expiry had say 3 months, you were not eligible to apply as in this case your 5 years clock would start from date of landing. This 90 days concession was allowed for those whose visa are expiring earlier. It is a concession by UKBA and not the RIGHT.

New English language requirment

Good morning group
My visa details as in my previous post. i am planning to apply for ILR on or after 17 august. me n my spouse lived together for 6 yrs now. We both passed LUT UK test. I read on these new rules for englsh language requirment. I have read the statement of intent and particularly appendix E.
my questions are
a) Does my spouse need to do B1 level english for listening n speaking?
b) Does my spouse need to be economically active ( he is not working currently but i am well above the earning requirment for principle ILR )

Hi

Once you and your spouse have passed the LIUK test then your spouse dont really have to pass any other Exams.

It doesn't really matter for your ILR if your spouse is working or not at the moment as it has got nothing to do with your ILR.

Thanks Smam for reply. My doubt remain unanswered as whom does the new rules apply. ? as i can see aplications after 9th of july for FLR / dependant (? ILR) will be affected with this. the guidelines doesnt really say its only for fresh application of entry clearance but infract it says for all the applications after 9th july.
