Tier 1 (General) extension Final Checklist

Post by zuby » Thu Jun 07, 2012 1:33 pm

Hello Guys,

I know this questions asked several times and I found more than 30 post related with this questions but still I need clarifications please.

D3. What date was the entry clearance or visa issued?
I came in UK in 2005 on student visa and my tier 1 visa granted in 2010 in India.
So which date is applicable, student visa 2005 or Tier 1 2010.
If its Tier 1 2010 then entry clearance date should be 2010, but first entry clearance in UK actually in 2005. :?

You entry clearance is the date on your entry clearance visa before you came to the UK. So in your case it is student visa 2005 entry clearance visa Valid from date

In effect, you had to leave UK to apply for EC for each of these categories and you've been granted EC three times for each of these categories. In other words, your stay in the UK has not been continuous since your entry in 2005 as a student.

So, to answer the question, specify the date EC was issued as a Tier 1 (General) migrant. Had it been a continuous stay since 2005 without a new EC since then, I would have agreed with what silent_warrior's response.

Hello sushdmehta,

Thanks for your reply but all my dependent visa granted in UK only for Tier 1 visa granted in India in 2010.

So as per Technical side I got 2 EC one for student visa in 2005 and one for Tier 1 General in 2010.

To explain my point of view:
D1. Did the applicant obtain entry clearance or a visa before entering the United Kingdom?
It doesn't ask - Did the applicant obtain entry clearance or a visa before entering the United Kingdom for the first time in the applicant's life?

D2 and D3 are related questions, and so are some others that follow.

Okay, perhaps at that time switching from student to HSMP / PBS dependant was allowed.

Regardless, the principle and my opinion remains the same.

So let me Summarise:-

Regardless, how many EC on your Passport, it’s always the first EC UKBA expecting from us?
So in my Case first EC is in 2005?
Am I Right?

No, the opposite ... the most recent EC (which in your case is the EC issued as a Tier 1 (General) migrant in 2010).

Don't know if you are still following this thread. But wanted to clear something. After 2005 did you go back and re-apply for entry clearance? Or did you remain as a student then went on to PSW and then Tier 1?

Mate, can I suggest you one thing. This comes from reading lot of threads in this forum. Pushy and impatient people don't get much response for their query. On top of that, your case is not unique, people have posted lot of similar threads and as Quicksam said, if you search you will be able to judge by yourself what you are missing in your documents list. Well that being said, on top of what you have added in your documents, I would include certain documents which are not needed but it will be helpful. The list of them is a follows:

Employer Letter with Salary break down. (An example of this can be found in the Sticky thread)

Marriage Certificate

Daughter's Birth Certificate(This one is mandatory if daugher is born here and its her first application)

Good Luck
