Have a scenario.

This girl lives in India and she had her 4rth kid and cannot travel and canno take care of her kids. She wants to send her new born to her mother in Canada just for 6mo/1year. Teh new born is still canadian citizen.

Her mother is ready to take the baby. Under what law the mother can take the baby from her daughter to help her out for an year?

Is there a possibilty?

Advise please.

How did the child acquire Canadian citizenship? This has a bearing on the range of responses.

His mother is a canadian born citizen living in India, she comes and goes within 6 month period. So by birth kid is canadian citizen according to the law.

Advise Please.

These two statements are contradictory as a minimum and instantly raise issues of misrepresentation i.e. the parentage in question is unlikely to be genuine.

A canadian citizen is eligible to enter and remain in Canada so the child has this right. Any adoption would have to be in the best interests of the child and in accordance with provincial/ federal laws. Citizenship and Immigration Canada understandably scrutinise these applications with great care particularly to authenticate any parentage...expect DNA tests if there are any concerns.
