Hello,

i got my ilr this month and i want to know 2 question:

1) can i apply now for citizenship now (living in uk last 7 years - 4 years student, 1 year psw, 2 years flrm - and never been out of uk)

2) i had 3 points from court for mobile phone (cu80) nearly 4 years now?

please advice me, thanks

1. Unless married to a British citizen, you cannot apply for naturalisation before the 1st anniversary of the day you received settlement.

Are you sure it is a conviction? Or are you assuming so?

3 points and fine from court. (for holding mobile for 7 second - checking time).

it was my mistake but i was enabled to submit my licence on time to police station for points due to busy in my studies. so i got letter by post from court for 3 points and fine.

driving licence counter part show's ---- sentence cu80.

plz advice

"Drink-driving offences, driving while uninsured or disqualified or driving whilst using a mobile phone are not minor offences" (Booklet AN; page 15). Reduces your chances considerably, to say the least. When will this conviction be spent? I wouldn't advise applying before that.

Get a basic CRB check and/or a PNC subject access done before you apply for naturalisation.

yes i already checked twice before applying ilr, all clear - nothing showing in crb and police record.

In such case, there is no "criminal conviction", only offence(s). Had you had a "criminal conviction" on your record, your settlement application would have been refused. As simple as that!

Contrary to popular belief, fines imposed by a court for motoring offences doesn't necessarily mean a "criminal conviction".

See also 3.2.2 - 3.2.4.

Is this the only offence you have been charged for in the last 5 years? If there is more than one, share the dates and provide relevant details.

i had conviction through court for mobile phone.

I don't have any other problem with my record (crb, with police or other driving offences) my record is clean. I checked crb at the time of ilr application and crb is clean.

In my ilr application i declared my court conviction and the date. ukba not asked me any single question regarding conviction.
