EEA2 residence card validity

Post by epoh » Mon Oct 29, 2012 2:57 pm

My spouse (non-EU national) got an EEA2 residence card in August 2011.
Between August 2011 and August 2012,
He was in the UK: From Aug. 2, 2011 to Oct. 23, 2011 and from March 24, 2012 to April 16, 2012.
He has been out of the UK: For the remaining months, and until now.
He should be back to the UK in December 2012: Can he enter with the EEA2 residence card or is the card not valid b/c he was out of the UK for more than 6 months b/t Aug. 2011 and Aug. 2012?
Thanks in advance!

Technically the RC may be invalid. But the carrier should only be interested in the expiry date of the RC which means there should be no problem reaching a UK port. UK border police should only be interested in the EEA national being resident in the UK and exercising treaty rights. If so, your spouse's right to enter is still in place.
