Hello

Some info please.

Mother was on spouse visa in uk has 3 children all british citizens. Husband never applied indefinate leave to remain for wife and complained to ukba and sent her back with children to pakistan.

She now wishes to come back to the uk as she has 3 children british.

What application can she make?

Please help someone life is at stake here

The children would need to be resident in the UK in order for her to apply as a parent.

My life is at stake too, but my case is other way round.

I am still an Indian citizen, never bothered about applying for BC.

My 2 years old daughter is British. My wife is English.

She has gone to visit my family in India, become very close to my sisters and their kids, and been there for 2 months.

How can I get my British wife and daughter back in UK? :roll:

I know she would have to be in the uk to make the application but the problem is getting her here

Not her; the children. That is the necessary qualifying condition. She can apply from her homeland if that is the case. Furthermore, she can't make the application in the UK if she is a visitor.

that's not correct. See GEN 1.3(c) a reference to a British citizen in the UK includes a British citizen coming to the UK with their partner/parent.

Would it not be better if she apply for family permit?

As i also think that if the child comes to uk then mother applicant can apply from pakistan for entry clearance as parent of a child in uk

Would family permit be better option?
