Hello Teamsters/Moderators

First of all thanks for loads of Useful Info which changed my mind & decided not to use solicitor

Gone through FAQ's also but not sure about few of my questions ,so posting here

My case

WP ( ICT) -18 Feb 2008-20 Feb 2010 ( got it for 2 years)

Extension of the same for 2 years under Tier 2 (ICT) PBS -20 Feb 2010 -20 Feb 2012

Further Extension under Tier 2 (ICT) Long Term Staff 20 Feb 2012 -20 Feb 2014


My widowed Mother ( Age 64+ ,will be 65 in Mid- March ) joined me as WP dependant ( I got the same based on my company's undertaking ) around June 2008 ,thereafter has been getting her renewals at same time as mine & has a dependant leave till Feb 2014

Got married in Dec 2008 & thereafter my Wife has been staying with me ( Since March 2009) & got her renewals alongwith me

My Son was born in August 2010 in UK .He also got his dependent leave renewals ( one around Nov 2010 & second alongside my extension in 2012)

Key Questions for The Moderators/Team/Experts

1- I assume I am eligible for ILR now ? will be able to get letter from Employer

MY SOC CODE is 2132- Software Engineer/System Analyst with a salary in range of 50K/annum ,How do i calculate monthly or hourly rate ,I am expected to work 8 hours

Please let me know or i can quote annual salary ??



2 - Since my Mother has also been classified as Dependent on me ,I assume she is also eligible for ILR ( Has got her Life in UK test pass ) ?I am the only Son & My Married sister also stays outside India

If yes then since she is in category of 18-64 I assume I need to fill a separate form for her & can't include her in my application,In past also for extensions I use to pay full amount ( same as main applicant) which means now also i will need to pay 1377 + separate form?? Please let me know on the same

If No ,then should I apply in any other category


3 For my UK Born Son ( He has Indian Passport + Leave renewals with me ) I an not planning to include him in ILR applicaton & plan to get his British passport directly ,Hope this is correct procedure or I need to include him in ILR application as well ,Don't plan to travel immediately ( next 3-5 months)

Any Response on above clarifications will be great help

Please let me know for any other info

1. You may apply for ILR if you satisfy 245GF.

2. I would have thought that your mother would also be eligible for ILR, in-line with you.

3. If you are granted ILR, then your previous uk-born child will be entitled to register for citizenship.

One last question- ( Hopefully) - Since I can't include my Mother onto my Set( O) Form (even though she is dependant) ,Should I fill separate Set(O) form for her with me mentioned a mail applicant or just a separate Set O for her but she is not a main applicant
