Residancy Query - Confused

Post by ilrdep » Sat Apr 27, 2013 8:27 am

One of my Friend who had ILR approved last year, he is now eligible for Citizenship but he has query rather thinking his ILR will be revoked if he applies for citizenship, his case as follows:

While obtaining ILR he had gap of 300 days in first year and another 250 days in the second year but case worker in PEO approved his ILR (no deception and also he mentioned all absences in the form but case worker approved) and he got the ILR. He is eligible for citizenship in the month of May (for only one month as he should be present in country) and his total absences are below 450 days in last five years.
His Queries:
1. Can he apply for citizenship now?
2. Will his ILR will be revoked if they look back his case as ILR was given case worker mistake or caseworker used his discretion (not sure on the reason)?

any suggestions appreciated

If he was granted ILR there is no reason to doubt it. You do not know his particular circumstances and providing everything was disclosed, he's done nothing wrong.

If he's had ILR for 12 months (unless married civil p of bc) and has met the other standard requirements, including 5 years residency and being physically present in the UK 5 years before his application is received by the HO then he should be naturalised. See http://www.ukba.homeoffice.gov.uk/briti ... uirements/ for the standard requirement including absences.
