ILR Eligibility

Hi Guys,

I need your help to understand whether I should apply for Tier 1 extension again or ILR.

I got Initial Clearance on 01 Dec 2008 valid until 01 Dec 2011.
I entered UK on 30 Jan 2009.
I applied for Tier 1 renewal in last week of November 2011.
Tier 1 Visa renewed from 27 Jan 2012 valid until 27 Jan 2014.

During my stay in UK I took following breaks to visit India:
May 2009 - around 10 days
Feb 2012 - around 1 month

I have similar confusion for my dependents

My wife and daughter joined me on 5 May 2009.
They got Tier 1 extension from 27 Jan 2012 vaild until 27 Jan 2014.
My son was born in Uk on July 2011. I filed his visa allow with my extension application. Hence his visa is also valid from 27 Jan 12 till 27 Jan 14.

My wife and kids had travelled to India on Feb 2012 for 2 months holiday.

Does the 5 year check starts from the day one enter Uk?
I entered UK on 30 Jan 09 and my visa expires on 27 Jan 2014, there is a gap of 3 days. Am I eligible to apply for ILR.
If yes, can I apply ILR for my dependents?
