ILR querires

Hi,

I have these queries based on the new rule effective 28th October 2013 regarding KOLL knowledge of language requirement and would appreciate the answers.

QUESTION 1. I have done my Bachelors of Engineering degree from one of the universities in Pakistan, this university is recognized in points based calculator (PBS) and I have already been proving my English language requirement when I applied for my initial Tier 1 General visa EC in the year 2009 and during my extension in 2012 with the document evidences of Degree and an English Proficiency Certificate stating my bachelors degree was taught in English from my university .

My query is can I use the same English language evidences for ILR that I've been using so far for Tier 1?
i.e.
University Degree AND English Proficiency Certificate from my university that Degree was taught in English

OR

Do I need to go either english test OR NAARIC?

QUESTION 2: Regarding calculating continuous period in UK for ILR application under Tier-1 (General).

Entry Clearance (EC) Visa Start Date: 11-Mar-2009
Entrance to UK Date: 05-Jun-2009
Current leave expiry date: 14-May-2014

So my question is that can I apply for ILR on 15th Feb2014? (which is 28 days before 5th anniversary of entry clearance date i.e. 11-Mar-2014)?

QUESTION 3: My kid is 3+ and goes to nursery (15 hours FREE from govt) and my understanding is that this shouldn't cause any issues in terms of claiming child benefits while applying for ILR? can you confirm please?

1. If your degree is taught in english, and is recognised on the PBS calculator, then you can submit the same evidence. There are already posts in the forum on this topic, see below.

The link says child benefit is public fund but others have said there is no problem in claiming this. please confirm ?
